 Me and my husband own a home. My sister took over mortgage and has rented it out going on 5 years. We found out the house had been deeded to her without our knowledge, 2 years ago. We told her to get the house refinanced and put in her name, so that we can take our names off the mortgage. She refuses. My husband and I cannot purchase another home because we are the first lien holder over this house. Our names is still on the mortgage. We have asked her to let’s put the house on the market so it could be sold. She doesn’t want to do that either. We have not gained one cent from this house. We have tried to hire 2 attorneys to take this case, but they decided they couldn’t do it, because they didn’t have the time. She has profited off of the house. This has caused a major strain in our family and all we want is to be is free. We even told her if it were to be sold, we would even compensate her. She still refuses. She says the house is no longer ours, it’s hers. She doesn’t think we should gain anything from it. We are so lost, and don’t know what to do. We made an agreement when my husband lost his job and I became disabled, to take over and get it rented out, until we could get to a point to sell it. Every year, she would tell us not now. Come to find out it’s deeded to her through the HOA. Is it anything else we can do?

  1. How did the deed get transferred without you signing it over? Yes, you signed note and are financially responsible. There is a due on transfer clause in the mortgage. So change in ownership may cause loan to come due.
