My brother was convicted of a charge that was NOT on his indictment. His indictment states "count 1 - criminal attempt to commit a felony" and now his count 1 states "attempted murder".

My brother was convicted of a charge that was NOT on his indictment. His indictment states "count 1 - criminal attempt to commit a felony" and now his count 1 states "attempted murder". He was not convicted of attempted murder and that's what it says on his sentence computation report and online as well. What could be done in his favor with this error and could this be a dismissal?
