Hi My mom is 77 years old.  She’s on Medicaid, and she owns a home.  I want her to come live with me, and sell the house.  She’s willing to come live with me , but she doesn’t want to sell the house. I understand that if she goes into the nursing home, the government can place a lien on her house, and she may lose her home.  What are Somme things we can do to protect her assets ?

A lot of people don't understand Medicaid laws , when on Medicaid yes upon death Medicaid can place a lien on the home to get back what it paid you need an elderly attorney to do it right as selling the home can make her ineligible for medicaid for up to 5 years there are ways around it like putting the house in a certain type of trust or doing a "lady bird deed" upon death deed but deed laws very by state if she rents the property out that will be considered income and also mess with her Medicaid The only real option here is to speak with an elder law attorney in your area as even her moving in with you can mess with her Medicaid eligibility as your household income will be counted twords eligibility
