So I have been working for almost a year at this restaurant full time. And when I asked employer for W2 he said we are independent contractorsOk…. Which means I’m going to have hella taxes owed… but I’ve worked in restaurants for everrrrrrree and never one time we were considered contractors. It’s a small restaurant so I’m wondering if he’s just doing it this way cus it’s easier but at the end of the day I’m an employee. I clock in, I wear his shirts, he pays us hourly like how is it like this and we are clearly employees… we never signed anything saying we are employees but he also never gave us any documents saying we are 1099 workers. So what do I do? And one of my co workers just got “fired” and she tried to atleast get unemployment but when he told her she was an independent contractor she becomes ineligible for that. Like what can we do? What do we do? Is there anything that can be done?
