Hello, everyone. NY state. Landlord doing repairs in the apartm downstairs since past tenants mov. He said he will be varnishing floors on a particular day, mentioned noise but nothing about smell. When we got home, our apt (2nd floor) smelled bad. We could not use gas stove as well since the vapors were burning and it smelled even worse. Called landlord, said will open windows and install fans inside the apt. Next coat he varnished we had to go to hotel, bcuz i am pregnant 7 month and have 5y-old. Told landlord, kind of mentioned he will pay… when we got back from hotel it was still terrible after 2-nd coat, and windows downstairs were completely closed, no escape for varnish fumes, but upstairs. I left windows open and heat on when we left for hotel (19 Fahrenheit). Called landlord and asked him to come and air the apt downstairs since it all goes up. Word to word, he said “move out or your rent goes up 400$ ( was 1600$) per month. We live in apt for 3 years, lease was up after a year, he said just to pay monthly…
So now, bcuz he didnt want to come and air the apt, our rent is up. In addition we could not use stove for a week ( even gas company came over, said to wait till fumes go away).
This is totally upsetting, taking into consideration my pregnancy and having 5 year old in the household, he didn’t do what he said he would and raised our rent for complaining.
Any advises will be highly appreciated!
